Do you expect this recent executive order to get challenged in court?
23 Jun 2020Answer
It is quite likely that this Order will be challenged in Court. Section 212(f) of the Immigration and Nationality Act gives the President the ability to restrict “entry” of foreign nationals into the U.S. The President’s powers and its limits under the law are not clear. Hence, litigation is expected by those impacted and organizations like the ACLU to challenge the President’s authority to issue such a wide Proclamation which has resulted in separating families and penalizing those who traveled for what they thought would be a short trip to apply for and obtain H1B/H4 or L-1 or L-2 visas abroad.
