We at The Law Office of Sheela Murthy have received reliable information that the visa numbers for EB3 Other Worker category will retrogress further or even become unavailable in the near future, as early as May 1, 2005. We are sharing this information with visitors to MurthyDotCom before the release of the Visa Bulletin by the U.S. Department of State (DOS). [The latest Visa Bulletin dates are made available on MurthyDotCom once they are released.]

Other workers, generally, are the unskilled and semi-skilled workers. These are positions requiring less than two years of training or experience. This category should not be confused with the EB3 category for skilled / professional workers.

The reason for the further retrogression of the Other Worker category is the continued demand for visa numbers in this category. This demand causes the U.S. Department of State (DOS), which controls visa number issuance, to establish an even earlier cut-off date in the Visa Bulletin. The DOS only has enough visa numbers for cases filed before the cut-off date indicated in the DOS Visa Bulletin. If the demand continues, it could create a situation in which the numbers in the EB3 Other Worker category are completely unavailable.

Unavailability occurs when there are no visa numbers that can be released by DOS in the particular category.
