Regional DOL Office Closure Schedule

A limited group of pre-PERM labor certification cases were not sent to the Backlog Processing Centers (BPCs). Rather, these cases continued to be under the control of existing U.S. Department of Labor (DOL) Regional Offices. As part of the DOL transition, these Regional Offices continued to process some labor certification cases even after the BPCs were established. This was always intended as a temporary measure, however, with all of these Regional Offices scheduled to close no later than December 31, 2005. The DOL has provided an update on the status of these Regional Offices, outlined below.

Boston Regional Office

The DOL announced that the Boston Regional Office closed in August 2005. This office is not accepting any telephone calls. Inquiries about cases that were at the Boston Regional Office may be sent to the National Processing Center (NPC) in Atlanta, GA.

New York Regional Office

The New York Regional Office has not started additional processing on any labor certifications since October 2005. The New York Regional Office is processing rebuttals and Notices of Findings (NOFs) that were generated on or before September 30, 2005. The office is accepting telephone calls through December 2005. As of January 2006, inquiries regarding cases previously located at the New York Regional Office may be sent to the NPC in Atlanta, GA.

San Francisco Regional Office

The San Francisco Regional Office has not started additional processing of any labor certifications since October 2005, except that they are continuing to process Special Handling cases for teaching faculty at institutions of higher education. The San Francisco Regional Office is processing rebuttals and NOFs that were generated on or before September 30, 2005. The office is accepting telephone calls through December 2005. As of January 2006, any inquiries regarding cases previously located at the San Francisco Regional Office should be sent to the NPC in Chicago, IL.

Seattle Regional Office

The Seattle Regional Office was closed in November 2005. The office is not accepting calls. Any inquiries regarding cases previously located at the Seattle Regional Office may be sent to the National Processing Center (NPC) in Chicago, IL.

BPCs and NPCs Remain Open

The BPCs remain open for processing the numerous pending pre-PERM cases. They will close at a future date, yet to be determined. The NPCs, which process PERM cases, will remain open for the foreseeable future. It is unknown how long the BPCs will remain open, though the DOL previously had indicated 24-30 months.
