November 2005 Visa Bulletin : No Change in EB Categories

The Visa Bulletin for November 2005 was issued on October 19, 2005 by the U.S. Department of State (DOS). As expected, there was no change in the Employment-Based (EB) categories. Those categories that are current remained so and those categories with cutoff dates continue to have the same cutoff dates. This means the same people who were already waiting for their priority dates to become available in order to file their I-485 applications will need to continue to wait. Those with I-485s pending will also continue to wait if their priority dates are not current.

It should be noted that those contemplating consular processing for immigrant visas will face the same problem at the consulates. While we often refer to the Visa Bulletin cutoff dates as pertaining to the I-485, they also govern whether immigrant visas can be issued at the U.S. consulates abroad. It is not possible, therefore, to bypass this problem by opting for consular processing.

It is expected that some slight forward movement in the cutoff dates may be evident in the December 2005 Visa Bulletin. Nationals of India and China, experiencing severely retrogressed dates in the first three employment-based categories (EB1, EB2, and EB3), will require a great deal of forward movement in order to benefit, as these are considered oversubscribed counties.
