Premium Processing Not Yet Available for I-140, I-539, or I-765

At the Murthy Law Firm, we have been receiving requests to premium process I-140 cases, as well as other types of cases that do not yet allow for premium processing. The source of these requests appears to be the designation by the USCIS of certain new types of cases, including I-140 petitions, for premium processing in the future. This future USCIS plan was reported in our May 26, 2006 MurthyBulletin article, Premium Processing to Expand: I-140s, I-539s and I-765s, available on MurthyDotCom. Premium processing is, essentially, expedited case processing by the USCIS in exchange for an additional premium fee of $1000.

The premium processing procedure for the I-140s, I-539s or I-765s has not yet implemented. The USCIS will make an announcement when they are ready to start processing these petitions or applications under the premium program. Of course, MurthyDotCom and MurthyBulletin readers will be informed as soon as there are further developments. Until then, only regular processing is available for all such petitions and applications. Therefore, it is necessary to plan the timing of one's filings and general immigration strategy in light of normal processing times.
