Labor Substitutions May Reach USCIS on July 16, 2007

The U.S. Citizenship and Immigration Services (USCIS) has clarified that it will continue to accept I-140 Petitions requesting substitution of labor certification beneficiaries through and including Monday, July 16, 2007. This is a change from a previous memo stating that the USCIS would reject substitution cases received by them on or after July 16, 2007. This change, means that the USCIS will accept labor substitution requests that reach the USCIS on July 16, 2007. Any labor certification substitution cases after that date will be rejected. This is based on the recent U.S. Department of Labor regulation discussed in our May 16, 2007 NewsFlash, LC Substitution Elimination Reg Effective July 16, 2007.
