New I-131 Form Introduced

The USCIS has introduced a new Form I-131, Application for Travel Document. The new version has a revision date of September 19, 2003. Previously, the revision date was December 10, 1991. As with most form changes, there is a grace period during which it is permissible to use either version. The new version, however, must be used for all cases received by the USCIS on or after January 1, 2004. If a case is going to reach the USCIS before that date, the older version of the form may still be used. After December 31, 2003, anything other than the September 19, 2003 version will be rejected. All deadlines reflect the date that the case is received by the USCIS, not the date it is mailed or postmarked. All USCIS forms are available from USCIS through MurthyDotCom. Instructions regarding which versions of the form to use, or when there has been a change are also available.

The major modification to the new form is that it requests information about consular notification for those who are applying for advance parole while outside the U.S. This does not reflect a change in the law or procedure with respect to advance parole eligibility for persons who have pending Applications for Adjustment of Status (Form I-485). It remains necessary to be physically present in the United States to apply for advance parole as an adjustment applicant. The instructions clearly indicate that this rule has not changed. The consular designation request is only for those who are seeking humanitarian parole. Humanitarian parole is a potential option for those persons who cannot enter the U.S. by any other means, but need to enter for medical or similar emergent reasons. Humanitarian parole is discretionary and granted on a case-by-case basis. It should never be thought of as a guaranteed means to reenter the U.S.

Those readers who may be signing I-131 forms now should determine whether they are signing the old or new version of the form. If it is the old version, then it is necessary to file the form with the USCIS on or before the December 31, 2003 expiration date.
