PERM : Address for
Mail-In PERM Applications

The U.S. Department of Labor (DOL) issued a Notice in the Federal Register
on February 8, 2005 providing mailing addresses for labor certifications
under PERM. These addresses are for employers that choose to mail their
applications rather than use the online system. The DOL took the opportunity
to again emphasize that they prefer electronic filings for all PERM
applications and that they generally expect electronic filings to be
processed more quickly.
PERM
electronic filings will be made through a specific website
(http://www.workforcesecurity.doleta.gov/foreign). As of this writing, since
PERM is not yet in effect, that URL does not yet contain the PERM filing
information.

If an employer chooses not to file electronically and the area of intended
employment is in Alabama, Connecticut, Delaware, Florida, Georgia, Kentucky,
Maine, Maryland, Mississippi, New Hampshire, New Jersey, New York, North
Carolina, Pennsylvania, Puerto Rico, Rhode Island, South Carolina,
Tennessee, Vermont, Virgin Islands, Virginia, Washington D.C., or West
Virginia, it should be filed with the U.S. Department of Labor, Employment
and Training Administration, Harris Tower, 233 Peachtree Street, NE, Suite
410, Atlanta, Georgia 30303.

employment is in Alaska, Arizona, Arkansas, California, Colorado, Guam,
Hawaii, Idaho, Illinois, Indiana, Iowa, Kansas, Louisiana, Michigan,
Minnesota, Missouri, Montana, Nebraska, Nevada, New Mexico, North Dakota,
Ohio, Oklahoma, Oregon, South Dakota, Texas, Utah, Washington, Wisconsin, or
Wyoming, it should be filed with the U.S. Department of Labor, Employment
and Training Administration, 844 North Rush Street, 12th Floor, Chicago,
Illinois 60611.

The Notice also provides that all labor certification cases received by the
State Workforce Agencies (SWAs) with a postmark of March 28, 2005 or later
will be returned to the sender. March 28, 2005 is the effective date of the
PERM labor certification regulation. All cases filed under current
procedures and postmarked before March 28, 2005 should be accepted by
the SWAs and processed under current procedures, either under the regular
Labor Certification or RIR process, rather than PERM. To be safe, it may be better to ensure that files are actually received at the SWAs
before March 28, 2005, if the parties wish to file under the existing
program instead of PERM.
