All 45-Day Letters to be Received by July 21, 2006

The Department of Labor (DOL) has indicated that all 45-day continuation letters for labor certifications pending with the Backlog Processing Centers (BPCs) will be sent and received by July 21, 2006. If, by that date, no 45-day letter has been received for a case, the employer or employer's attorney should send an eMail. [Send to nobeccontact@dal.dflc.us for cases at the Dallas BPC, or to nobeccontact@phi.dflc.us for cases at the Philadelphia BPC.] The eMail should include the attorney's name and address, the employer's name and address, the beneficiary's name and address, the priority date of the case, and the state or regional location and/or number where the case was originally filed. The DOL has not yet described what will be done with these eMails or what type of communication can be expected in response.

There are still many cases that have not received 45-day letters. It is likely, therefore, that many will have to undergo this procedure. We will keep MurthyDotCom and MurthyBulletin readers apprised of our experiences with this process.

To ensure that the DOL may be contacted promptly under the system that has been set up for this purpose, one should contact her/his attorney or the employer's attorney if the 45-day letter from the DOL has not been received by July 21, 2006.
