USCIS Accepted LC Approval Printouts for Retrogression Filing

The USCIS advised on September 29, 2005 that they would accept computer screen printouts reflecting labor certification approval until September 30, 2005. This change was designed to help with those green card cases for which the labor certification had been approved on or before September 29, 2005, but for which the hard copy had not yet arrived. While, normally, one would just wait to receive the hard copy, retrogression / visa unavailability made it necessary for many people to attempt filing I-485 Application for Adjustment of Status cases before October 1, 2005. Therefore, the USCIS temporarily relaxed the specifications requirement regarding the acceptable evidence to be submitted, demonstrating the approval of the labor certification for the I-140 Petition filing, which is, in turn, a necessary part of employment-based I-485 filings.

It was only possible to use this printout procedure for cases reaching the USCIS through September 30, 2005. News of this should come as a relief, however, to those who tried this approach without knowing whether it would work. Hopefully, the USCIS will employ this method in the future, should the need arise under similar circumstances, with cutoff visa dates or other situations.
